Le rappeur a obtenu une victoire proc\u00e9durale \u2013 purement formelle \u2013 avec la r\u00e9tractation par le tribunal de Marseille de sa demande de fermeture d\u2019un compte Instagram de l\u2019artiste. Le compte Instagram @OKLM du rappeur reste malgr\u00e9 tout ferm\u00e9 suite \u00e0 une d\u00e9cision du r\u00e9seau social.<\/p>\n<p class=\"article_link\">Dans son ordonnance de r\u00e9f\u00e9r\u00e9 lundi, le tribunal judiciaire a reconnu que sa d\u00e9cision initiale avait \u00e9t\u00e9 rendue <i>\u00absur une base l\u00e9gale irr\u00e9guli\u00e8re et doit de ce fait \u00eatre r\u00e9tract\u00e9e\u00bb<\/i>. Il s\u2019est n\u00e9anmoins d\u00e9clar\u00e9 <i>\u00abincomp\u00e9tent\u00bb <\/i>concernant un \u00e9ventuel r\u00e9tablissement du compte, demand\u00e9 par la d\u00e9fense du rappeur.<\/p>\n<p class=\"article_link\">Il s\u2019agit d\u2019<i>\u00abun point purement proc\u00e9dural\u00bb<\/i>, souligne Meta. La maison m\u00e8re d\u2019Instagram rappelle que la d\u00e9cision de d\u00e9sactiver le compte de Booba <i>\u00aba \u00e9t\u00e9 prise en application\u00bb<\/i> de r\u00e8gles internes \u00e0 Instagram, \u00e0 la suite de signalements d\u2019utilisateurs et de l\u2019ordonnance du tribunal, <i>\u00abmais aucunement \u00e0 la demande\u00bb<\/i> de Magali Berdah.<\/p>\n<h2 class=\"heading__StyledHeading-sc-5jxglz-0 jztCkt\">Bataille judiciaire<\/h2>\n<p class=\"article_link\">Le 30 mai, le tribunal judiciaire de Marseille avait ordonn\u00e9 la fermeture du compte Instagram du rappeur, apr\u00e8s une requ\u00eate de Magali Berdah. Elle accuse Elie Yaffa (alias Booba) de harc\u00e8lement sur les r\u00e9seaux sociaux. Ce dernier a rapidement ouvert un nouveau compte Instagram, @eliyaffaofficiel, avant de faire appel au juge des r\u00e9f\u00e9r\u00e9s. Le 1er juin, la justice marseillaise a \u00e9mis une ordonnance similaire concernant le compte Twitter de l\u2019int\u00e9ress\u00e9, @booba. Celui-ci, en revanche, reste toujours ouvert \u00e0 ce jour.<\/p>\n<p class=\"article_link\"><i>\u00abTu as perdu Magali, et tu vas perdre sur tout le reste\u00bb<\/i>, \u00e9crit le rappeur sur Twitter, engag\u00e9 depuis plusieurs mois dans un conflit juridique et m\u00e9diatique avec Magali Berdah, patronne de Shauna Events, une des principales agences d\u2019influenceurs en France.<\/p>\n<p class=\"article_link\">D\u00e9but septembre, la justice a ouvert une enqu\u00eate pour <i>\u00abpratiques commerciales trompeuses\u00bb<\/i> contre Shauna Events, \u00e0 la suite d\u2019une plainte formul\u00e9e par le rappeur. De son c\u00f4t\u00e9 Magali Berdah a obtenu l\u2019ouverture d\u2019une enqu\u00eate contre Booba.
