The case was mentioned before the CJI by advocate Shadan Farasat, who argued that Muslim girls are unable to appear for exams due to the ban on hijab in colleges. He further argued the girls had already lost one year and the exams are scheduled to begin from March 9.
The CJI enquired as to who was stopping the girls from taking the examination. In response, the lawyer said they were being prevented since they were wearing a headscarf (hijab). He assured that he will take a call on the matter.
On January 23, senior advocate Meenakshi Arora had urged the bench for urgent listing of the matter, arguing that the exams of the petitioners were slated for March.
Assuring an urgent fixing of a date, the CJI had asked the counsel to mention the matter before the SC registrar. « This is a three-judge bench matter. We will do it, » the CJI had said in January.
The petitioners have contended that after the split verdict by the apex court, the aggrieved students moved to private colleges from government colleges.
